1. Agreement

These Terms of Service ("Terms") govern your use of Nomify (the "Service"), operated by [your legal entity] ("Nomify", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Nomify does

Nomify generates business and brand name suggestions from a description you provide, checks domain availability for those names, and unlocks the full results after a one-time payment. Suggestions are produced by an automated system and are provided for your consideration only.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract to use the Service.

4. Names and domains are suggestions, not guarantees

• Name suggestions are ideas, not legal, branding, or trademark advice. You are responsible for deciding whether a name is suitable and free of third-party rights.
• We confirm domain availability at the time of the check using registry data, but availability can change at any moment. We do not guarantee a domain remains available until you register it, so register promptly.
• Before using or registering any name, do your own trademark search (for example with the USPTO or EUIPO) and seek professional advice if needed. We are not responsible for trademark, intellectual-property, or other disputes arising from names you choose to use.

5. Payment

Unlocking your full results is a one-time payment of $4.99 (or the price shown at checkout). Payments are processed by Polar, our Merchant of Record, which acts as the seller of record and handles billing, taxes, and receipts. Your purchase is also subject to Polar's terms. Refunds are governed by our Refund Policy.

6. Affiliate links

Some "register" links in the Service and in our emails are affiliate links. If you register a domain through one, we may earn a commission at no additional cost to you. This never influences which domains we show you: availability is determined by the domain registry, not by any commercial relationship.

7. Acceptable use

• Do not use the Service for unlawful purposes, to infringe the rights of others, or to generate names intended to impersonate or mislead.
• Do not scrape, resell, or access the Service through automated means except as we expressly permit.
• Do not attempt to bypass payment, rate limits, or security measures.

8. Intellectual property

You are free to use the name suggestions you receive, and we claim no ownership of a name you choose. The Service itself, including its software, design, and the Nomify brand, remains our property. Names are generated by a third-party AI model and are not guaranteed to be original or unused by others.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that results will meet your expectations.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or losses arising from names or domains you choose to use.

11. Changes

We may update these Terms from time to time. Material changes are reflected by updating the date above. Continued use after a change means you accept the updated Terms.

12. Governing law and contact
